Understanding the New Electronic Monitoring Law

This Guide has been put together to help employers navigate issues around drafting an Electronic Monitoring Policy and understanding the electronic monitoring law.

Ontario has enacted Bill 88, Working for Workers Act, 2022, which has amended the Employment Standards Act, 2000 to create a new requirement for employers to have a written policy in place with respect to electronic monitoring. The deadline for employers to have this policy in place is October 11, 2022.
